TERMS AND CONDITIONS
These Terms and Conditions are entered into by and between you (“the Client”) and Emma Franklin, trading as The Canine Separation Anxiety Consultant (“the Trainer”), upon purchase of any services.
Please read these Terms and Conditions carefully. They include important information regarding your rights, responsibilities, and limitations of liability.
By enrolling in any services provided by the Trainer, you confirm that you have read, understood, and agree to be bound by these Terms and Conditions, along with the Privacy Policy.
SERVICES PROVIDED
The Trainer provides online canine separation anxiety coaching services, which may include:
Behaviour questionnaires
Assessment Zoom calls
Personalised training plans
Video review and feedback
Ongoing support via WhatsApp or email
All services are delivered remotely.
ONLINE TRAINING DISCLAIMER
All services are provided remotely. The Trainer does not have physical control over the dog, the environment, or how training plans are implemented.
Outcomes depend on accurate reporting, consistent implementation, and environmental factors outside of the Trainer’s control. As such, no guarantees are made regarding results or timescales.
CLIENT RESPONSIBILITY
The Client remains fully responsible for the management, supervision, and welfare of their dog at all times.
The Trainer provides guidance and recommendations only and is not responsible for the actions or behaviour of the dog, or any outcomes resulting from the implementation (or non-implementation) of training advice.
CLIENT COMPLIANCE
The Client agrees to follow all training and management guidance provided.
The Trainer shall not be held responsible for any outcomes where advice is not followed, including (but not limited to) situations where the dog is left alone outside of agreed training parameters.
Failure to engage with the programme, submit required videos, or follow guidance may result in termination of services without refund.
TRAINING STRUCTURE
The programme includes a maximum of five personalised training plans per week.
Training plans are created based on the Client’s submitted video footage. The Trainer cannot provide new training plans without reviewing the previous session.
It is the Client’s responsibility to submit videos in a timely and accessible format. Delays in submission may result in delays to the training process.
Missed training sessions are not carried forward to subsequent weeks.
Consistency is essential for progress. The Client agrees to follow the structure of the programme and complete sessions as advised.
APPOINTMENTS AND COMMUNICATION
Scheduled sessions must be cancelled or rescheduled with a minimum of 48 hours’ notice.
Late arrivals (more than 15 minutes) will be considered a no-show and the session will be forfeited.
Communication via WhatsApp or email will be responded to within reasonable working hours.
PAYMENT AND REFUNDS
All services must be paid for in advance or via an agreed instalment plan.
Where an instalment plan is selected, this represents a payment arrangement for the full programme fee. By agreeing to an instalment plan, the Client commits to paying the total cost of the programme in full, regardless of participation, completion, or early termination.
Failure to make scheduled payments may result in suspension or termination of services. Any outstanding balance will remain due and payable.
Fees are non-refundable except where required by law. Where a refund is issued, it will be limited to unused services.
The Trainer reserves the right to terminate services at their discretion. In such cases, the Client remains liable for any services already provided and any outstanding payments under the agreed plan.
VETERINARY AND MEDICAL DISCLAIMER
The Trainer is not a veterinarian and does not diagnose medical conditions.
The Client agrees to ensure their dog is in good health and to seek veterinary advice where appropriate. Any behavioural concerns that may have a medical basis should be discussed with a qualified veterinary professional.
PROHIBITED METHODS
The use of aversive training tools or methods is not permitted during participation in services. This includes, but is not limited to, shock collars, prong collars, choke chains, spray collars, and similar devices.
Use of such tools may result in termination of services without refund.
INTELLECTUAL PROPERTY
All materials provided by the Trainer are for personal use only and may not be shared, distributed, or reproduced without prior written consent.
RECORDINGS AND DATA
Sessions may be recorded. The Client may also submit videos, images, or other media for review.
Such materials may be stored securely and used solely for the purpose of delivering services.
The Client is responsible for ensuring that any media shared does not contain sensitive or identifying information they do not wish to disclose.
LIMITATION OF LIABILITY
Nothing in these Terms excludes or limits liability where it would be unlawful to do so, including liability for death or personal injury caused by negligence.
Subject to this, the Trainer’s total liability shall be limited to the total amount paid by the Client for the services.
INDEMNITY
The Client agrees to indemnify and hold harmless the Trainer against any claims, losses, damages, or expenses arising from the Client’s handling or management of their dog, including the implementation of any training advice provided.
UNFORESEEN CIRCUMSTANCES
The Trainer shall not be liable for delays or failure to perform services due to circumstances beyond reasonable control, including but not limited to illness, technical issues, or third-party failures.
BEHAVIOUR
Clients are expected to behave respectfully at all times. The Trainer reserves the right to terminate services without refund in cases of abusive or inappropriate behaviour.
GOVERNING LAW AND JURISDICTION
These Terms and Conditions are governed by the laws of England and Wales.
By purchasing services, the Client agrees that any disputes arising in connection with these services shall be subject to the exclusive jurisdiction of the courts of England and Wales.
INTERNATIONAL CLIENTS
Services may be provided to clients located outside of the United Kingdom.
Clients acknowledge that all services are delivered from the United Kingdom and agree to the governing law and jurisdiction set out in these Terms.
AGREEMENT
By purchasing services, the Client confirms acceptance of these Terms and Conditions in full.
